The Hirer

In these Conditions and in the Hiring Agreement, “Hirer” means any person, company, corporation, or government instrumentality (including personal representatives, permitted assigns, and any person or corporation entitled or required by law to administer the Hirer’s affairs) who hires any equipment from CLEARLIGHT SHOWS PTY. LTD.

Insurance

All responsibility for goods on hire rests with the Hirer. No equipment is covered by insurance while on hire. The Hirer agrees to pay all costs for unpaid hire, damage to, or loss of any goods on hire.

Damage

The Hirer agrees to pay all repair costs for equipment damaged during the hire period and to reimburse CLEARLIGHT SHOWS PTY. LTD. at the applicable daily hire rate for the period during which the equipment is unavailable for re-hire due to damage. If the equipment is damaged beyond economical repair, the Hirer agrees to pay the full replacement value within 14 days of invoice.

Late Return

If equipment is returned after 11:00 am on any day, CLEARLIGHT SHOWS PTY. LTD. reserves the right to charge rental until 11:00 am on the following business day. A business day means any weekday other than a public holiday.

Default in Payment / Right of Recovery

If the Hirer defaults in payment of any monies payable or fails to comply with these terms and conditions, CLEARLIGHT SHOWS PTY. LTD. or its assigns may retake possession of the equipment and may enter any premises where the equipment is located. Termination of the hire under this clause does not affect the right of CLEARLIGHT SHOWS PTY. LTD. to recover outstanding monies or damages for breach of these Conditions. The Conditions of Hire are printed on the reverse side of the Hire Agreement and should be read carefully before hiring equipment.

Charges

Minimum hire is $55.00. Delivery and pick-up incur a minimum charge of $49.50 each way. Payment in full is required on collection unless an account has been established. A refundable cash deposit is required for all hires, including a $100.00 deposit for all drapes. Long-term hire rates are charged per week with a minimum hire period of two weeks. One lead per light is supplied free of charge; additional leads incur extra charges. All prices are subject to GST.

Identification

Full photographic identification must be produced at the time of collection, such as a driver’s licence or passport.

Equipment

CLEARLIGHT SHOWS PTY. LTD. is not responsible for any issues arising from a customer’s inexperience in operating hired equipment. The company reserves the right to substitute suitable alternative equipment if required.

Lamps

Where applicable, spare lamps are supplied with the hire and must be returned with the equipment. Faulty or blown lamps must be returned for inspection. The Hirer accepts full responsibility for lost or broken lamps.

Loss or Damage

Any loss of or damage to equipment during the hire period is the full responsibility of the Hirer. If equipment is lost, the Hirer agrees to pay the full replacement value within 14 days of invoice.

Testing and Tagging

All equipment supplied by CLEARLIGHT SHOWS PTY. LTD. is tested and tagged by qualified technicians. For long-term hire, responsibility for maintaining current testing and tagging rests with the Hirer.
